1. Introduction

1.1 What These Terms Cover: These Terms of Sale, along with our Privacy Statement, outline the legal terms and conditions under which we supply products listed on our website, www.candlewarehouse.ie, to you.

1.2 Why You Should Read Them: Please read these Terms carefully before placing an order. They will apply to any contract for the supply of products from our website. By submitting your order, you agree to these Terms. If you do not accept them, you will not be able to place an order.

1.3 Updates to These Terms: We may amend these Terms from time to time, as detailed in Clause 5. Please check these Terms each time you place an order to ensure you are aware of the terms that will apply.

1.4 Age Requirement: You may only purchase products from our website if you are 18 years of age or older.

2.1 Who We Are: We are CandleWarehouse Ireland Limited, a company registered in Ireland. Our VAT number is IE9711355H, and our registered office is at W7B Ladytown Business Park Newbridge Road, Naas, Co. Kildare, W91 WH99, Ireland.

3. Our Contract With You

3.1 Acceptance of Your Order: A contract is formed when we send you a shipping confirmation email. An acknowledgment email of receipt does not constitute acceptance of your order.

3.2 Partial Acceptance: If we can only partially fulfill your order due to stock limitations, we will notify you and process only the available items. You will be charged only for the products in stock.

3.3 Refusal of Order: If we cannot accept your order (e.g., due to stock issues, pricing errors, or unmet delivery deadlines), we will inform you and issue a refund for any amount already paid, including delivery costs.

3.4 Order Number: We will assign an order number for your reference. Please use this number when contacting us about your order.

3.5 Delivery Location: We only sell and deliver products within Ireland. We also deliver to Austria, Belgium, Croatia, Czechia, Denmark, Estonia, France, Finland, Germany, Hungary, Italy, Latvia, Lithuania, Luxembourg, Netherlands, Portugal, Slovakia, Slovenia, Spain (excl Canary Islands) & Sweden.

4. Our Products

4.1 Product Variations: Product images on our website are for illustrative purposes only. We cannot guarantee that your device will display the product colours accurately. Products may vary slightly from their images.

4.2 Packaging Variations: Product packaging may differ from what is shown on our website.

4.3 Personalised Products: Ensure you have permission to use any third-party intellectual property in personalised products. We may refuse or cancel orders with inappropriate or infringing content. If this occurs, we will notify you, cancel the card authorisation, and charge you nothing.

5. Changes to Our Products or Terms

5.1 Product Changes: We may update products to comply with legal or regulatory requirements without affecting their use.

5.2 Changes to These Terms: We may revise these Terms to reflect changes in laws or regulations.

6. Providing the Products

6.1 Delivery Costs: Delivery costs are as displayed on our website.

6.2 Delivery Timeline: We aim to deliver within 5 days of accepting your order (Ireland only).

6.3 Delays: If delivery is delayed due to unforeseen events, we will inform you and attempt to minimise the delay. If significant delays occur, you may cancel the contract and receive a refund for undelivered products.

6.4 Delivery Issues: If you are not home for delivery, check your tracking number for parcel location. If the delivery cannot be completed, it may be taken to a local DPD Access Point for collection.

6.5 Non-Delivery: If delivery fails or products are not collected within 7 days from the DPD Access Point, the order will be returned, canceled, and refunded (excluding personalised products).

6.6 Contacting Us About Delivery Issues: Contact us within 7 days of the scheduled delivery date if you have not received your order or if it is damaged or incorrect. Failure to do so may limit your ability to receive a refund or replacement. This does not affect your statutory rights.

6.7 Responsibility and Ownership: You are responsible for the product once delivered. Ownership transfers upon full payment.

7. Your Rights to End the Contract

7.1 Ending the Contract: Your rights to end the contract depend on the nature of the product and the timing:

  • Faulty or Misdescribed Products: You may have a legal right to end the contract, request repair/replacement, or get a refund.
  • Contract Changes or Errors: If we notify you of an error in pricing or description or if delivery is significantly delayed, you can end the contract immediately and receive a full refund.
  • Changing Your Mind: For most online purchases, you can change your mind within 14 days and receive a refund. See Clause 8.3 for the enhanced cancellation rights.

7.2 Personalised Products: No right to change your mind for personalised products unless they are faulty or misdescribed.

8. How to End the Contract

8.1 Notify Us: Contact us via telephone, email, or our Contact Us Form at https://candlewarehouse.ie/pages/contact to end the contract.

8.2 Cancelling Before Dispatch: We will attempt to cancel the shipment. If not possible, contact us for a return. You must return goods within 14 days of notifying us.

8.3 Returning Products: If the contract ends after dispatch or receipt, contact us for a return. Return products within 14 days.

8.4 Refunds: Refunds will include product charges only, unless faulty. Deductions may apply for reduced product value due to handling or if a more expensive delivery method was chosen.

9. Our Rights to End the Contract

9.1 Breach of Contract: We may end the contract if you fail to make payments as due.

9.2 Pricing Errors: If we process an order with a pricing error, we may end the contract, refund you, and request the return of the products.

9.3 Fraud Risk: We may cancel the contract if fraud is suspected and will not charge your card.

10. If There Is a Problem with the Product

10.2 Returning Rejected Products: Return products in person, by post, or arrange collection by DPD. 

11. Price and Payment

11.1 Price Information: Product prices (including VAT) are as indicated at checkout. We strive to ensure accuracy but refer to Clause 9.2 for pricing errors.

11.2 Payment Methods: We accept VISA, MASTERCARD, PAYPAL, APPLE PAY, and GOOGLE PAY. Payment is required before dispatch. 

11.3 Incorrect Order Confirmation: Contact us if you believe an order confirmation is incorrect.

12. Our Responsibility for Loss or Damage

12.1 Foreseeable Loss: We are liable for foreseeable loss or damage resulting from our breach of contract or negligence.

12.2 Legal Liability: We do not exclude or limit liability where unlawful, including death or personal injury, fraud, or breach of legal rights.

12.3 Business Losses: We are not liable for business-related losses.

14. Other Important Terms

14.1 Contract Validity: If any part of these Terms is deemed illegal, the remaining Terms will remain in force.

14.2 Delays in Enforcement: Delays in enforcing contract terms do not waive our right to enforce them later.

14.3 Governing Law: These Terms are governed by Irish law. Legal proceedings must be brought in Irish courts.

15. Discount Codes

15.1 Application of Discount Codes: Discount codes must be entered at the checkout stage to be valid. To use a discount code, simply input the code into the designated field during checkout and apply it to receive the discount. Please ensure you apply the code before completing your purchase. Once an order is processed and payment is confirmed, the discount code cannot be applied retroactively to that order.

15.2 Validity and Expiration: Each discount code comes with an expiration date, which will be specified at the time of issuance. Discount codes are valid only during the period indicated and cannot be used beyond their expiration date. It is your responsibility to use the code before it expires. Expired codes will no longer be valid, and no extensions or replacements will be provided.

15.3 Restrictions and Exclusions: Certain products, categories, or offers may be excluded from discount codes. These exclusions will be clearly stated at the time the discount code is issued. For example, discount codes may not apply to sale items, clearance items, or certain brands. Additionally, discount codes cannot be combined with other offers or promotions unless explicitly stated. Always check the specific terms and conditions associated with each discount code to understand any restrictions that may apply.

15.4 Misuse and Fraudulent Activity: Discount codes are intended for personal use and may not be shared or resold. We reserve the right to refuse or cancel orders that involve misuse of discount codes, such as fraudulent activities, abuse of promotional offers, or violation of the terms and conditions. If we detect any suspicious or inappropriate use of discount codes, we may take necessary actions, including but not limited to, voiding the discount, canceling the order, or banning the account responsible for the misuse.

15.5 Code Adjustments and Customer Support: If you encounter any issues with applying a discount code or believe there has been an error, please contact our customer support team as soon as possible. We are here to assist with any problems related to discount codes, but please note that we cannot adjust or apply codes to completed orders.

15.6 Promotional Offers: Occasionally, discount codes may be part of special promotional offers. These promotions may have additional terms and conditions, which will be communicated clearly at the time of the offer. Make sure to review all terms associated with any promotional codes to fully understand their application and restrictions.

15.7 No Cash Value: Discount codes have no cash value and cannot be exchanged for cash or any other form of credit.
